Abstract: CDF contributed to Section 2.3 of this Whitepaper by the Wadhwani Foundation titled ”Personal Data Protection Act – Ambiguities, Limitations and Recommendations”. As a whole, this Whitepaper thoroughly examines select sections of the current Digital Personal Data Protection Act, 2023 to identify areas of concern and ambiguity, explores best practices from other jurisdictions that could provide solutions, and offers recommendations for resolving these ambiguities.
Some of our specific recommendations in the paper include – appointing an intermediary certification body for compliance with the protection of minors’ data; drawing guidelines to specify data processing and implementing privacy by design and age-appropriate design as per the ICO guidelines.
